SUBJECT:      CLARIFICATIONS ON THE APPLICABILITY OF DEPED ORDER NO.
                       49, SERIES 2018 TO PUBLIC AND PRIVATE SCHOOLS

Relative to the concern on the start of Christmas vacation of teachers, everyone is hereby instructed to direct their attention to the attached copy of the Unnumbered DepED Memorandum from the Office of Undersecretary Jesus L. R. Mateo dated 05 December 2018, content of which is self-explanatory.

In view thereof, it is reiterated that per paragraph 2 of said Memorandum, Christmas vacation or all teachers shall also start on 16 December 2018 just like the learners’ for reasons already stated therein. However, should they be required to report and render services from 16 to 22 December 2018, certain requirements shall be satisfied as cited.

Pivate schools may deviate from the school calendar per paragraph 2 of DepED Order No. 25, series 2018 as long as the minimum number of class days is completed.

SUBJECT:                     Clarifications on the Applicability ofDepEd Order No. 49, s. 2018 to

Public and Private Schools

This Office has been in receipt of queries from various stakeholders, both from the public and private sectors, regarding tin” implication of DepEd Order (DO) No. 49, s. 2018 entitled

Amendments to DepEd Order No. 25 s. 201S on the attendance of public and private School teachers. In this regard, the Regional Offices and Schools Division Offices are hereby instructed to ensure dissemination of the herein clarifications.

On the applicability of DO No. 49 s. 2018 to Public Schools

DO N6. 4’J, s. 2018 moves the start of the Christmas vacation for learners from December 22 to December 16, 2018 to enable them to spend more quality lime and strengthen emotional bonds with their families. In the same way, Christmas vacation for teachers shall also start on December 16, 2018. However, in the exigency of public service, teachers may be required to report and render services from December 16 to 22, 2018, which shall be compensated with the equivalent vacation sen-ice credits, as per DO No. 53, s. 2003.

Note that requests to require the attendance of public school teachers during the said period must satisfy the following conditions:

1) A letter-request is submitted by the school head to the Schools Division Office.

2) Suficient justification is provided to establish thai exigency of public service exists.

3) Hie request is duly approved by the Schools Division Superintendent (SDS).

I’or purposes of this issuance, “exigency of public service” refers to a situation where service is urgently needed and where any delay in its execution and delivery will adversely affect the outcome of the service to clients and its effective and efficient delivery.

On the applicability of DO No. 49 s. 2018 to Private Schools

The Department encourages private schools to adopt the revised school calendar. However, paragraph 2 of DO No. 2=5 s. 2018 entitled School Calendar for School Year 201S~20W provides that private schools may deviate from this school calendar as long as the minimum number of class days is completed and the provisions of Republic Act No. 7797 or the Act to lengthen the School Calendar from Two Hundred (200) Days to Nol More Tlnm Two Hundred Twenty (220) Class Days are observed In like manner, the attendance of pivate school teachers shall be the prerogative of the school’s management.
